1. Content Liability

We shall not be held responsible for any content including photos, videos, logos, comments, links, and other materials that appear on your PWA and Website. You agree to protect and defend us against all claims that are rising on your PWA and Website. No link(s) should appear on any PWA and Website that may be interpreted as libellous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights. Unauthorized use of the Content or any other content on the Site is strictly prohibited.

When you submit content to Multivcard, you still own it. You do, however, give us permission to use it in the ways necessary to provide our services. For example, when you upload a photo, you give us the right to save it, and also to display it on your digital business card in your direction. 

2. Conditions of Use

Users of the Services may provide us with content, including text, photos, video, any other materials (“User Content”). Your Content stays yours. These Terms do not give us any rights to User Content, except for the limited rights that enable us to provide, improve, and protect the Services.

Users of the Services are solely responsible for all information, data, text, images, video or other materials (“Content”) that they upload, post, publish, display, transmit or send (collectively, “Transmit”) or otherwise use via the Service.

We reserve the right to investigate and take appropriate legal action against anyone who, in Multivcard's sole discretion, violates this provision, including without limitation, suspending or terminating the account of such violators and reporting you to the law enforcement authorities.

Users of Services agree to not use the Services to:

(a) Transmit any content that (i) infringes any intellectual property or other proprietary rights of any party; (ii) you do not have a right to transmit under any law or under contractual or fiduciary relationships; (iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (iv) poses or creates a privacy or security risk to any person; (v) constitutes unsolicited or unauthorized advertising, promotional materials, “junk mail,” or “spam,” (vi) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libellous, invasive of another's privacy, hateful racially, ethnically or otherwise objectionable; (vii) in the sole judgment of Multivcard, is objectionable or which restricts or inhibits any other person from using or enjoying the Service, or which may expose Multivcard or its users to any harm or liability of any type;

(b) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or

(c) violate any applicable local, state, national or international law, or any regulations having the force of law;

(d) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(e) solicit personal information from anyone under the age of 18;

(f) harvest or collect email addresses or other contact information of other users from the Service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;

(g) submit to Multivcard Personal Data relating to third parties without the consent of such third parties;

(h) further or promote any criminal activity or enterprise or provide instructional information about illegal activities; or

(i) obtain or attempt to access or otherwise obtain any materials or information through any means not intentionally made available or provided for through the Service.

4. Termination

Multivcard may terminate or suspend your right to access or use Multivcard for any reason on appropriate notice. 

5. Limitation of Liability 

Multivcard is not responsible or liable to you or third parties for any consequential or indirect loss, financial damages, downtime, or lost profits or opportunities, resulting from incorrect functionality, loss of service, loss of data, breach of contract, negligence, or other claims.

Multivcard  will not be liable to you for any special, direct, indirect, incidental, consequential, punitive, reliance or exemplary damages, including but not limited to losses or liability, damages for loss of goodwill, use data or other intangible losses, whether based on contract, negligence, strict liability or otherwise, resulting from: 

(a) personal injury or property damages; 

(b) The use or the inability to use the product and service; 

(c) loss of data, loss of revenue, anticipated profits, or loss of business opportunity; (d) unauthorized access to or alteration of your data or transmissions, 

(e) any unauthorized use of or access to the Site, the Services, any of our servers including, without limitation, any User Content or data including personal and/or financial information stored thereon;

(f) statements or conduct of any third party on the service, any viruses, worms, bugs or the like which may be transmitted to or from the Site of any third party;

(g) any way that is not permitted under applicable law; 

(h) for any fraud or fraudulent misrepresentation;

Some jurisdictions do not allow the disclaimer or exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. If any portion of these sections is held to be not valid under Application Laws, the invalidity of such portion shall not affect the validity of the remaining portions of the Applicable Sections.

In no event shall our aggregate liability exceed the total amount paid by you to us in relation to this service.

6. Disclaimer of Warranties

You understand that your use of the Site and the Products and Services is at your sole risk. The Site and the Products and Services available via the Site are provided by use on an “AS IS'' and “AS AVAILABLE” basis.

Multivcard expressly disclaims all warranties of any kind, whether express, implied or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

7. Third Party Services and Sites

a.Third Party Services

The Service may provide, or third parties may provide, links or other access to other sites, services, products, and resources on the Internet  (collectively, “Third Party Services”). These Third Party Services have their own terms and policies, and your use of them will be governed by those terms and policies. We have no control over such Third Party Services and Multivcard is not responsible for and does not endorse such Third Party Services. Your security when using Third Party Services is your responsibility. You also agree that we may, at any time and in our sole discretion, and without any notice to you, suspend, disable access to or remove any Third party Services.You further acknowledge and agree that Multivcard will not be responsible or liable, directly or indirectly, for any such suspension, disabling or removal, including without limitation for any loss of profits, revenue, data, goodwill, or other intangible losses you may experience as a result thereof. Any dealings you have with third parties found while using the Service are between you and the third party, and you agree that Multivcard is not liable for any loss or claim that you may have against any such third party.

b.Third Party Sites

The Services may contain links to Third Party Sites. You access Third Party sites at your own risk. We don't control and aren't liable for those sites.

c. User content

We can't review all of the User Content made available via the Services. The Services may contain User Content such as: (i) offensive or objectionable; (ii) errors; (iii) harmful for your device; (iv) violates intellectual property, publicity, privacy or rights of third parties; (v) copying or use of which is subject to additional terms and policies. By operating the Services, we don't represent or imply that we endorse User ConTent provided therein, or that we believe such User Content to be accurate, useful or non-harmful. We’re not liable for, nor publisher of, any User Content uploaded, posted, published or otherwise made available via the Services. You're responsible for protecting yourself and your devices from User content accessed via the Services.

8. Access and Use of the Service

You are granted permission to access and use this Site and its Content  for the sole purpose of preparing, evaluating, and purchasing Multivcard Products and Services through the Site. No other download, retention, use, publication, or distribution of any portion of the Content is allowed. You agree to use this Site and our Products and Services in a responsible manner that is in compliance with these Terms and Conditions and your local laws and regulations, including export and import regulations. We assume no liability or responsibility for any inaccuracies, errors or omissions in any Content. Multivcard also assumes no responsibility and shall not be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing on the Site or your downloading any materials, data text or images from the Site.

By accessing, using and placing orders on the Site, you warrant that you have all necessary permission, right and authority to do so and you authorize Multivcard to produce the Products you order. You also agree to be bound by these Terms and Conditions, our Privacy and Policy a nd to any additional related policies, guidelines, restrictions or rules that may be posted from time to time. All such additional posted guidelines, restrictions, or rules are incorporated herein by reference.

9. Privacy

All information collected about you during use of the Service and the Site will be used in accordance with our Privacy Policy and all applicable laws. Please read Privacy Policy.

10. Bot is not permitted

Bots are normally used to automate certain tasks, meaning they can run without specific instructions from humans. An organization or individual can use a bot to replace a repetitive task that a human would otherwise have to perform. Bots are also much faster at these tasks than humans. 

11. End-user license agreement (EULA)

Your Digital Business Cards may have their own visitors and users (“End Users”). You understand and agree that Your Digital Business Cards and your End Users are your responsibility, and you’re solely responsible for compliance with any laws or regulations related to Your Digital Visiting Cards and your End Users, including without limitation the posting of your own privacy policy. We’re not liable for, and won’t provide you with any legal advice regarding, yours Digital Visiting Cards or your End Users.

12. Fair Use  

We may restrict or cancel your use of the service if such use is deemed by us to be excessive or adversely affects the experience of other users.

13. Legal Use

Any materials or content you upload to the service must be legal both in your area of jurisdiction and in Mauritius, and you must have the rights to use such materials.

14. Pricing 

Our goal is to honor the pricing shown on the Site, however, we reserve the right to change published prices of products offered on our Site at any time.

You agree to pay any and all fees and payments due for Products or Services purchased at this Site at the time they are ordered. All Payments are non-refundable.

One thing we’d like you to keep in mind is that all sales, unless otherwise noted, are final. Multivcard puts special care into working on your job and will not be able to give a refund once we’ve begun working. Life is unpredictable, and some circumstances are beyond our control. We cannot be held responsible for: Spelling, punctuation or grammatical errors made during your customization process Poor image quality or low-resolution of your uploaded files Design or colour selection errors you submitted during the file creation process.

15. Age Restriction

You must be an adult – i.e., eighteen (18) years old or more (if so required under applicable law)("Age of Consent") and capable of lawfully entering into this Agreement. Please contact us if you have any concerns or questions about this restriction.

16. INTELLECTUAL PROPERTY

Our logo and trademarks, whether registered or not, may not be copied, imitated or used, in whole or in part, without our prior written consent. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress and may not be copied, imitated or used, in whole or in part, without our prior written permission.
